Copyright notices

Every game on Whimcade is made by an AI build agent from a creator's one-paragraph wish. Creators confirm, each time they publish, that their game does not copy another game's name, characters, art, music or look (Terms, section 4). If you believe a game here copies your work anyway, tell us and we will look at it quickly.

Sending a notice

Under the US Digital Millennium Copyright Act (17 U.S.C. § 512), a notice needs:

1. the copyrighted work you believe is infringed (a title, a link, or a description);
2. the link to each Whimcade game you say copies it, for example https://whimcade.com/play/game-name;
3. your name, postal address, phone number and email;
4. a statement that you believe in good faith the use is not authorised by the copyright owner, its agent, or the law;
5. a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them;
6. your physical or electronic signature (typing your full name works).

When a notice is complete we unpublish the named game and tell its creator. Knowingly false claims can make the sender liable for damages (17 U.S.C. § 512(f)).

If your game was taken down

If you published a game we removed after a notice and you believe that was a mistake, you can send a counter-notice with: the link to the removed game; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and phone number; your consent to the jurisdiction of the federal district court for your address (or, outside the US, any district where Whimcade may be found) and to accept service from the person who sent the notice; and your signature. Unless the sender tells us they have filed a lawsuit, we may restore the game 10 to 14 business days after we receive it.

Repeat infringers

We unpublish the games of, and in appropriate cases close the accounts of, creators who repeatedly publish games that infringe other people's rights. Something else wrong with a game, like content that breaks our Content Policy? Use "Report this game" under it in the arcade.
