Welcome to Whimcade ("we", "us"). Whimcade lets you describe a game idea in a paragraph — a "wish" — and an AI build agent turns it into a small browser game you can play, refine, and publish to our public arcade. By submitting a wish, playing a game, or otherwise using whimcade.com, you agree to these terms.

1. The service

Whimcade generates games automatically with AI. Game generation is creative and best-effort: we do not guarantee that a generated game will match your idea, work flawlessly, or be available within any particular time. Free usage (number of builds and refinement messages) is limited, and limits may change at any time.

2. Your wish, your game

• You keep any rights you hold in the idea text you submit. Only submit ideas you are allowed to share.
• You may play, share, and link to the games created from your wishes for any personal, non-commercial purpose.
• You grant Whimcade a worldwide, non-exclusive, royalty-free license to host, run, reproduce, display, and promote your wish and the games generated from it — including showing published games in the public arcade and in Whimcade marketing.
• Generated games are produced by an AI system. We make no promise that a generated game is unique, free of third-party claims, or protectable as your intellectual property.

3. Acceptable use

Do not use Whimcade to:

• request clones of trademarked games or franchises, or content that infringes others' rights;
• request sexual, hateful, harassing, or otherwise abusive content (see our Content Policy);
• probe, overload, or interfere with the service, evade rate limits or free-tier limits, or automate submissions;
• attempt to make a generated game perform attacks, mine cryptocurrency, collect player data, or otherwise act against the people who play it.

4. Published games and moderation

Publishing puts your game in the public arcade. We may unlist, remove, or refuse to build any content at our discretion, including content that violates these terms or our Content Policy. Publishing does not freeze a game: when you keep iterating, the arcade serves the newest ready version.

5. Availability and changes

Whimcade is provided "as is" and "as available", without warranties of any kind. We may modify, suspend, or discontinue any part of the service — including removing games or resetting data — at any time. We are still early; please treat the service as a beta.

6. Limitation of liability

To the maximum extent permitted by law, Whimcade and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim (which, for free use, is zero).

7. Age

You must be at least 13 years old to submit a wish or provide an email address. If you are under 18, use Whimcade only with a parent or guardian's permission.

8. Changes to these terms

We may update these terms from time to time. The "Last updated" date above reflects the current version; continued use after a change means you accept the new terms.
